Sujit Choudhry on How Can One Protect the Constitution from Populist and Autocrat Attacks

Those reading or practicing in the field of constitutional law must know about Sujit Choudhry. As one of the most well known figures in comparative constitutional law in Canada and the U.S., Choudhry has carved a certain reputation for himself that remains unsurpassed by many in the field.

After graduating from McGill University in 1992, Choudhry got enrolled in the coveted University of Oxford and went on to obtain his Bachelor of Arts in law degree in 1994. But he didn’t stop there. He also went ahead to obtain his L.L.B. degree from the University of Toronto. And then he topped it by doing his L.L.M. from the reputable Harvard Law School in 1998.

Since then, Sujit Choudhry has been active in the field of law, where he went on to specialize in the field of comparative constitutional law. Starting as a law clerk at the Supreme Court of Canada, Choudhry went on to hold faculty positions in institutions such as the New York University School of Law and University of California, Berkeley.

Today, Choudhry is regarded as one of the most reputable entities in his sector, which is due to his years of hard work in the field. As someone who believes in sharing his knowledge, he often lends his expertise to online publications, where he writes about niche topics of constitutional law that are helpful for those learning about the subject.

Quite recently, Sujit Choudhry wrote about the ways to protect a country’s constitution from populist and autocratic attacks from within the region itself. As a very interesting topic, the law expert had some interesting points to share.

For once, Sujit Choudhry mentioned that generally, a constitution yields the power to reduce risks to its integrity through planned stops and delays in the execution of such plans. This gives those in power and influence to come together in order to stop such attacks before they happen, so the constitution could be protected.

With it, Choudhry also mentioned that when it comes to autocratic attacks on the constitution, it should be made clear that they are not able to manipulate or entrench the system to their advantage. For this, he pointed out the importance of baselines of entrenchments that would keep the constitution protected in such instances.

Sujit also elaborated that the constitution should be drafted in such a manner where it imposes certain regulations on political parties, so that any actions through do not undermine the constitution itself. He also gave out the example of parties weakening the rights of the opposition, which in turn is bad for the constitution’s integrity itself. In order to steer clear from such issues, it is essential for the constitution to be imposing regulations right from the start.

Sujit mentioned that by following these points, one could protect the constitution from being entrenched, manipulated or attacked by populists or autocrats in a very effective manner.

Politics is becoming a key field in this day and age and it is important to have people like Sujit.
